ABBAMAIL is an on-line community of ABBA fans.
ABBAMAIL began on January 13 1997 and has become the most cohesive ABBA fan forum on the internet.
ABBAMAIL has been set up by ABBA fans who want to encourage fans to share news, information and views on ABBA and related topics. We do encourage spirited and free-flowing debate - as long as the dialogue doesn't get abusive.
We also encourage a healthy balance of ABBA related and 'lifestyle' posts. This community is a *real* community: we want to know who you are and what you are about. People often use the list to share problems and ask for advice. That’s a key difference about ABBAMAIL’s community compared to other forum’s based “purely” on ABBA related topics.
1. General
ABBAMAIL’s Internet Mailing list is referred to as “the list”.
The list is owned by Whitread Pty Ltd, referred to as “ABBAMAIL Administration”.
You are a subscriber to the list and your joining the list constitutes your full acceptance of all the terms, conditions, rules and notices contained in this Agreement.
Subscription to the list will be strictly conditional on your full acceptance of the terms, conditions, rules and notices as set out below, including such variations as may be advised in writing to the list from time to time by ABBAMAIL Administration. Please ensure that you read, understand and are fully aware of all these terms and conditions, which are binding and constitute the Agreement between ABBAMAIL Administration and you.
Whilst the general set of rules applicable to the management and operation of the list are set out below, ABBAMAIL Administration retains the right to add to, alter or withdraw any of the terms, conditions, rules and notices at any time. Notice of any such changes will be provided in writing to the list in advance of any such changes.
PLEASE NOTE THAT ABBAMAIL'S INTERNET MAILING LIST IS AIMED AT A MATURE AUDIENCE - AGE 15+. ABBAMAIL TAKES NO RESPONSIBILITY FOR ANY PERSON OFFENDED BY MATERIAL POSTED TO THE LIST. IF YOU ARE UNDER 15 YEARS OF AGE, WE WILL REQUIRE YOU TO PLEASE CHECK WITH YOUR PARENTS BEFORE SUBSCRIBING AND WE RESERVE OUR RIGHT TO CONTACT YOUR PARENTS TO CONFIRM THAT SUCH AUTHORITY HAS BEEN PROVIDED.
2. Subscription Fee and no refund policy
Subscription to ABBAMAIL shall be at the invitation of ABBAMAIL Administration, which reserves the right to refuse any application for subscription without giving any reason for its decision. Such decision is at the absolute discretion of ABBAMAIL Administration and is final.
Subscription to the list is not transferable. Subscription fees are payable to ABBAMAIL Administration for its own benefit, use and management at its sole discretion.
Subscription to the list is subject to the payment of a monthly subscription fee (“the fee”). The fee must be paid in advance via the payment methods listed on ABBAMAIL’s website (www.abbamail.com).
If your subscription is approved by ABBAMAIL Administration and the appropriate fee is paid, you will be subscribed to the list with one single email address. You must supply the email address at the time of your subscription.
Your list membership will be effective from the date that payment is first authorised and received by ABBAMAIL Administration for the period of the relevant subscription.
You agree that ABBAMAIL Administration, at its own discretion, may immediately terminate your subscription at any time and without prior notice if we believe that you have materially breached or have failed to comply strictly with the terms, conditions, rules and notices of the list.
If your subscription is terminated or cancelled in accordance with the terms and conditions, ABBAMAIL Administration will not provide any refund under any circumstance of any part of your subscription and/or membership fees, either already paid, in full or at a pro-rata rate. This condition is strictly binding and not negotiable. No further correspondence will be entered into concerning the fee cancellation as a result of your subscription being terminated or cancelled.
Additionally, if you choose to pay the subscription fee for another person who is subscribed to the list, the subscription and/or membership fee will not be refundable under any circumstances. This condition is strictly binding and no further correspondence will be entered into concerning the fee cancellation.
If your payment method is made on a quarterly recurring basis using either a recognised Credit Card or via PayPal and you decide to cancel your list subscription at any time during that quarter, the most recent quarterly fee amount will be automatically forfeited in full. No further payments will be deducted from your Credit Card or PayPal if you cancel your subscription but there will be no refunds whatsoever for fee payments already deducted. This condition is strictly binding and no further correspondence will be entered into concerning part fee payments.
If you are removed from the list or if your posts are moderated for failure to adhere to the terms, conditions, rules and notices contained in this Agreement or such variations as may be advised by ABBAMAIL Administration from time to time, any fee you have already paid will not be refunded for that period during which you are removed from the list or during which your posts are moderated.
ABBAMAIL Administration may suspend or terminate a user's subscription at any time and without prior notice.
3. Indemnity
ABBAMAIL Administration provides no warranty and shall not be liable in any way for any claim, demand, action, damages, costs (legal or otherwise), expenses, injury or loss of any kind, commercial or otherwise, suffered by any list subscriber due to their list membership and/or participation in the list.
You agree to indemnify, defend and hold ABBAMAIL Administration harmless from any claim, demand, action, damages, costs (legal or otherwise), expenses, injury or loss of any kind, commercial or otherwise, incurred by ABBAMAIL Administration as a result of any claim, demand, action or other proceeding arising directly or indirectly as a result of your list membership and/or participation to the list.
4. List Operation
ABBAMAIL Administration will make every reasonable endeavour to ensure the smooth and continual operation of the list. However, ABBAMAIL Administration accepts no liability for, and provides no warranty regarding, the ongoing operation of the list.
If the list ceases to operate due to circumstances beyond the control of ABBAMAIL Administration, no refund of subscription fee will be paid for that period of time that the list is not operational or in the event the list ceases to operate in full.
5. Delivery of list emails
During the period of your subscription, it is your responsibility to ensure that your email account is able to receive emails from the list. ABBAMAIL Administration is not responsible if your Internet Service Provider, Mail Server, Web Browser or other email provider is unable to receive emails from the list for any reason whatsoever. If there are genuine technical issues preventing you receiving list emails we may, at our discretion, offer you the option of changing the email address you are subscribed to the list with.
6. Posting to the list
The official language of the list is English - all posts to the list must be in English. Posts to the list must be in plain text – the list is set up to reject posts in HTML.
Posts to the list may be moderated by ABBAMAIL Administration.
ABBAMAIL Administration has the right to modify or exclude material from discussion. The list moderators also have the right to exclude individuals from discussion if they believe the list standards have been or are likely to be breached;
All posts to the list must be signed with your name, city or state and country.
Subscribers are individually responsible for regularly reviewing the list’s terms and conditions, rules and additional terms posted on the site. Whilst any additions or amendments to the terms and conditions will be notified by ABBAMAIL Administration to the list, you will be individually responsible for being fully aware of, and compliant with, all of the terms and conditions.
Subscribers to the list agree not to:
• Use gratuitously obscene language;
• Harass, threaten, insult, attack any other list subscriber or member(s) of the ABBAMAIL Administration team;
• Be defamatory, whether explicitly or by inference, against any member of the list or ABBAMAIL Administration;
• Be involved in, or advocate, illegal or criminal activities whilst members of the list;
• Engage in any behaviour, written or otherwise, which may be to the detriment of the list or ABBAMAIL Administration;
• Interfere with, restrict or inhibit the enjoyment or use of the list by other subscribers;
• Violate human rights on the list by any behaviour, written or otherwise;
• Display, send to or promote any offensive and/or pornographic material on the list;
• Condone, promote or incite violence on the list by any behaviour, written or otherwise;
• Portray any persons, either on the list, or ABBAMAIL Administration or in the public domain in a demeaning or offensive manner;
• Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age against any member of the list or ABBAMAIL Administration;
• Engage in any activities, written or otherwise, which could reasonably be construed as invasive acts of any list member’s privacy, including repeated unsolicited and direct personal contact;
• “Troll” or bait other list members or ABBAMAIL Administration by posting inflammatory statements designed to illicit a negative response from an individual or groups;
• Spam through to the list repeated posts or any off-topic content;
• Distribute or use another member’s personal details (such as email address or other information) to any third party.
• Impersonate another person;
• Collect and/or store any personal data about other users of the ABBAMAIL list and Community without their specific written or oral consent;
• Re-post or cross-post to any third party, other websites, discussion groups, chats or forums posts which first appeared on the list unless prior and explicit written consent is obtained from ABBAMAIL Administration;
• Attack the list owners, ABBAMAIL Administration and list management policies either publicly or via another website forum;
• Post any attachments (including but not restricted to photographs, documents, formatted text, coloured backgrounds etc.) to the list;
• Use the list to attack, degrade or vilify other public artists or groups.
• Mention, promote or advertise any items, website, products or organisations that clash with ABBAMAIL's own mail order service. Any ABBAMAIL product, either in full or in part, which may have been copied and made available for sale by other persons or organisations to ABBAMAIL may not be mentioned on the list;
• Post to the list any chain mail, spam messages, electronic cards, messages about viruses etc.
The above rules are a general guideline for all list subscribers but not exhaustive. ABBAMAIL Administration reserves its right to add to, edit or remove any of thes rules from time to time. Prior notice of any such changes will be provided to the list in writing. 7. AdvertisingSubscribers to the list shall not use the list for any commercial or advertising purposes, private or otherwise. There will be no use of any advertisements referring to ABBAMAIL and/or ABBAMAIL Administration in any document, publication or internet site without ABBAMAIL Administration’s prior written consent. Commercial operators should contact ABBAMAIL Administration directly at abbahq@zipworld.com.au to discuss individual requests for advertising. 8. Privacy and Confidentiality Policy
ABBAMAIL Administration will not release subscriber names or email addresses to a third party. The list of subscribers and their email addresses will only be available to ABBAMAIL Administration.
Both you and ABBAMAIL Administration agree to maintain the confidentiality and privacy of any personal information obtained in the course of subscribing to and using the list services, and to comply with all privacy legislation or laws applying to personal information in your state or country of origin.
9. Complaints
All complaints relating to the administration of the list should be made in writing to ABBAMAIL Administration at abbahq@zipworld.com.au. All complaints will be acknowledged within 48 hours of receipt and a response will be provided within fourteen (14) working days.
Any decision arising from a complaint shall be made at the sole discretion of ABBAMAIL Administration and will be final.
10. Jurisdiction
The laws of Australia only shall apply to this Agreement.
11. Section headings and severability
The headings in this Agreement are inserted for convenience of reference only and shall not affect the interpretation. If any term or provision of this Agreement is altered, edited or deemed to be invalid, such alteration, editing or determination shall not invalidate the rest of this Agreement which shall remain in full force and effect.

13. Unsubscribing / cancelling list subscription
